Cookie Policy

1. PURPOSE AND SCOPE

This Cookie Policy ("Policy") describes the use of cookies and similar tracking technologies on the website at , operated by Egemenoğlu Law Firm ("Egemenoğlu", "Data Controller"). It also covers all related mobile applications, platforms and digital services (collectively referred to as the "Platform" and/or "Site"), the legal basis of these technologies, the purposes of processing, and how users may manage their preferences.

This Policy constitutes an integral part of the Firm's Personal Data Protection and Processing Policy and Clarification Text and should be evaluated together with the aforementioned documents.

Apart from the essential cookies used on the platform, other cookies are only used in accordance with the user's preferences and subject to their explicit consent. Users may change or withdraw their cookie preferences at any time.

2. LEGAL BASIS

The Firm carries out its personal data processing activities through cookies within the framework of the following legal regulations:

  • The Personal Data Protection Law No. 6698 ("KVKK") and the secondary legislation issued on the basis of this Law,
  • Decisions and directives of the Personal Data Protection Board ("Board"),
  • Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through These Publications,
  • Law No. 6563 on the Regulation of Electronic Commerce and related regulations,
  • Relevant European Union legislation (GDPR 2016/679 and ePrivacy Directive 2002/58/EC), to the extent applicable.

Personal data processing activities carried out through cookies are based on the following legal grounds under Article 5 of the KVKK: "expressly provided for by law", "legitimate interests of the data controller", or "express consent of the data subject". Mandatory cookies are processed on the basis of legitimate interests, as they are strictly necessary for the technical provision of the service. For all other categories of cookies, the express consent of the user is required.

3. WHAT IS A COOKIE?

Cookies are small text files that are saved on your device (computer, tablet or smartphone) by your browser when you visit a website. They are used for many purposes such as ensuring the proper functioning of websites, remembering user preferences, personalizing the user experience and performing statistical analysis.

In addition to cookies, pixel tags (web beacons), local storage, session storage and similar tracking technologies can also be used. This Policy covers all these technologies and they are evaluated under the concept of "cookie".

Cookies may process information that qualifies as personal data, such as browser and device identifiers, IP address, session information and behavioural preferences — even though they do not contain directly identifying information such as national identity numbers or health data.

4. TYPES OF COOKIES

4.1. Cookies According to Their Duration

  • Session Cookies: These are temporary cookies that are valid throughout the user session and are automatically deleted when the browser or application is closed. These cookies do not create a permanent file.
  • Persistent Cookies: These are cookies that remain on the device for a specified period of time even if the browser is closed. They store user preferences and settings for subsequent visits, ensuring continuity of the experience. They disappear when their expiration date has passed or are deleted by the user.

4.2. Cookies by Source

  • First-Party Cookies: These are cookies that are created directly by the visited Platform and can only be read by this Platform. They are directly managed by the Firm.
  • Third-Party Cookies: These are cookies created by organizations other than the visited Platform (advertising networks, analytics service providers, social media platforms, etc.). These cookies are processed under the privacy policies of these third parties, and the Firm does not have direct control over the content and processing of these cookies.

4.3. Cookies According to Their Purpose of Use

  • Mandatory/Technical Cookies: These are cookies that are absolutely necessary for the basic functions of the Platform. Without these cookies, some parts or services of the Platform cannot function properly. User consent is not required for the use of these cookies.
  • Functional Cookies: These are cookies that remember the user's preferences, such as language selection, geolocation preferences, and interface customizations. Such cookies prevent the user from re-entering their preferences with each visit, providing a personalized experience.
  • Performance and Analytical Cookies: These are cookies related to statistical data collected to understand and measure how users use the Platform. The information obtained is processed in anonymized form and used to improve the Platform.
  • Targeting and Advertising/Marketing Cookies: These are cookies used to show users ads that align with their interests, measure the effectiveness of advertising campaigns, and optimize marketing strategies. These cookies are typically managed by third-party advertising networks and are processed on the basis of express consent.

5. COOKIES USED ON THE PLATFORM

The cookies used on the Platform are listed in the table below. The retention period starts from the date of the transaction if the data is submitted by the user (e.g. filling out a form, clicking a button), or from the date of the last visit if the data is collected automatically.

6. PURPOSES OF PROCESSING PERSONAL DATA

The Firm processes all personal data, including personal data obtained through cookies, in line with the principles stipulated in Article 4 of the KVKK. In this context, cookies are processed for the following purposes:

  • To ensure the technical operation of the site, to manage the server infrastructure and to ensure cyber security,
  • To ensure that the applications made through the contact form are processed,
  • To save user preferences and provide personalized experience,
  • To analyze site visitor behavior, measure site traffic and improve site performance,
  • To comply with the relevant legal obligations and to provide information to authorized institutions and organizations,
  • To perform statistical analysis of user behavior in order to improve the Services.

7. EXPRESS CONSENT MANAGEMENT

Mandatory cookies are processed on the basis of legitimate interests under Article 5/2 of the KVKK and without express consent, as these cookies are indispensable for the technical operation of the Platform.

Functional, analytical and advertising/marketing cookies are processed on the basis of the user's express consent in accordance with Article 5/1 of the KVKK. Users may give or withdraw consent on a per-category basis through the cookie consent mechanism presented on their first visit to the Platform.

Express consent is obtained by: (i) adequately informing the user, (ii) ensuring consent is given freely, (iii) obtaining consent for a specific and defined purpose, and (iv) ensuring it is express in form. The "Reject All" option is made available for all non-mandatory cookies.

The user may withdraw express consent at any time. Withdrawal of consent does not affect the lawfulness of any processing carried out prior to such withdrawal.

8. THIRD-PARTY COOKIES AND INTERNATIONAL DATA TRANSFER

The Platform includes services through which cookies belonging to these third parties can be transmitted to Platform visitors through third-party service providers (analytical tools, advertising networks, social media platforms, etc.). These third-party cookies are processed within the framework of the privacy policies of these service providers.

Personal data collected by third-party service providers may be transferred to servers located abroad. Such transfers are carried out on the basis of the appropriate safeguards provided for under Article 9 of the Personal Data Protection Law (KVKK) or, where necessary, with the explicit consent of the data subject.

Although the Firm does not have direct control over the processing activities of third-party cookies, it only works with business partners that comply with the KVKK and concludes the necessary data processing agreements.

9. DATA SECURITY

The Firm takes appropriate technical and administrative measures within the framework of Article 12 of the KVKK in order to ensure the security of all personal data, including personal data collected through cookies. Within the scope of these measures:

  • Encryption of personal data and use of secure transmission protocols (SSL/TLS),
  • Implementation of access authorization and authentication mechanisms,
  • Performing periodic vulnerability scans,
  • Organizing privacy and data security trainings for employees,
  • In case of a data breach, making the necessary notifications in accordance with Article 12 of the KVKK and the decisions of the Board.

10. COOKIE MANAGEMENT AND USER PREFERENCES

Users can manage their preferences regarding cookies in the following ways:

10.1. Cookie Consent Mechanism: Users can set their preferences on the basis of cookie categories through the cookie consent banner that appears on their first visit to the Platform and update these preferences at any time through the Cookie Preferences Center.

10.2. Browser Settings: Users can block all or certain types of cookies, delete existing cookies, or enable cookie warnings from the settings of the internet browser they use. The following steps can be followed for cookie management on a browser basis:

If cookies are blocked at the browser level, some functions of the Platform may not work partially or completely; user experience may be negatively affected. Blocking mandatory cookies may make it impossible to benefit from the Platform.

10.3. Third-Party Opt-Out Tools: For cookies related to third-party advertising and analytics services, the respective service providers' own opt-out tools may be used. Examples of accessing these tools are the Digital Advertising Alliance (www.aboutads.info), the European Interactive Digital Advertising Alliance (www.youronlinechoices.com), or the Google Analytics Opt-out plugin.

11. RIGHTS OF THE DATA OWNER

Pursuant to Article 11 of the KVKK, you have the following rights as a personal data owner:

  • To learn whether your personal data is processed or not,
  • If your personal data has been processed, to request information about it,
  • To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
  • To be informed of the third parties to whom your personal data is transferred, whether domestically or abroad,
  • To request correction of your personal data if it is incomplete or incorrectly processed,
  • To request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
  • To request notification of the transactions regarding the correction, deletion or destruction of your personal data to third parties to whom your personal data has been transferred,
  • To object to any decision that is taken solely on the basis of automated processing of your personal data and that produces an adverse effect on you,
  • To request compensation for the damage if you suffer damage due to unlawful processing of your personal data.

You can submit your applications regarding your rights in question, within the framework of Article 13 of the KVKK and the Communiqué on the Procedures and Principles of Application to the Data Controller, together with the documents proving your identity, by the following methods:

  • Written application (with wet signature): Application in person or transmission through a notary public at Azerbaycan Cad. 1 B Blok No:109 B Office No:56 Kat 25 34418 Sarıyer / Istanbul,
  • Application signed with a secure electronic signature: Transmission to e-mail address,
  • Via KEP (Registered Electronic Mail): Transmission to [email protected] KEP address.

Your application will be responded to free of charge by the Firm within thirty (30) days at the latest, depending on the nature of the request, in accordance with Article 13 of the KVKK. If the request requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.

12. POLICY UPDATES

The Firm reserves the right to update this Policy in line with changes that may occur in the legal regulations, the technical infrastructure of the Platform, cookie usage practices or business processes.

Important changes to the Policy will be announced to users by publishing a statement on the Platform, sending an e-mail to users and/or reactivating the cookie consent mechanism. Changes will be effective from the date of their publication.

Continued use of the Platform after the update date constitutes acceptance of the updated Policy. Accordingly, users are advised to review the Policy regularly.
